TOPS Repricer ("Company", "we" or "TOPS Repricer") is dedicated to protecting the information of Users and respects their right to privacy when using its e-commerce services Platform and Site ("User" or "you"). We think you have a right to be aware of how we handle any information we may gather and use about you when you use our Platform (as that term is defined below).

1. Your permission (Very crucial; pay close attention!)

You agree to the terms and conditions outlined in this privacy policy by using the platform, connecting to it, or accessing it. This includes consenting to the possible collection and processing of your personal information as specified above. You may not enter, connect to, access or use the site and/or platform in any manner if you disagree to any term provided herein.

The platform requires you to link it to the APIs of third-party e-commerce service providers in order to use it. By doing so, you grant TOPS Repricer access to and the ability to extract certain data, including but not limited to personal information held by these third-party service providers, and/or copy such information as needed. We will only extract this data to provide you with the services available through the platform. We never have shared and never will share personal information for any kind of marketing purpose with a third party.

2. Which data about our users might we gather?

We may collect two types of data and information from our Users:

A) The first is non-personal and anonymous information. We don’t know who we’ve collected the non-personal information from. Non-personal information is any unidentifiable information that doesn’t allow us to identify an individual User and that we have access to when they install and/or use our Platform. The non-personal information that we collect includes technical data, behavioral data, and aggregate data. Examples of non-personal information include: User’s activity on the site and/or platform Operating system Device type Click-stream Keyboard language Screen resolution Time spent on different screens of the site or platform.

B) The second type of data is personal data and data collected through Amazon SP API (“Personal Data”). Personal data includes inventory information and sales data associated with your Amazon seller account. Personal data may identify you or may be private and/or confidential.

- The IP address is provided automatically by users of the Site or Platform primarily for the purpose of improving the User experience, geo-positioning and security.

- TOPS Repricer may collect, use and provide access to the User’s advertising identifier in accordance with such identifier provider’s policies.

- When you approve TOPS Repricer as a developer on Amazon Seller Central, TOPS Repricer will collect data on your Amazon listings, and inventory, by accessing SP API.

- Any personal information identified in the User Data originating from your established third-party E-commerce Account(s) through the APIs of such third-party service provider (using the open standard for authorization known as OAUTH), inclusive of pertinent API authentication tokens. It's important to highlight that we will solely extract information essential for delivering the Services offered via the Platform.

- Personal Information may be gathered from the details provided by the User when contacting us through the support page accessible on the Platform or by sending an email.

To be clear, any non-personal information that is connected, linked to, or associated with any Personal Information shall be considered as Personal Information for as long as such connection, linkage, or association persists.

We refrain from gathering any Personal Information from you or concerning you without your explicit approval, which is acquired, among other methods, through your acceptance of the Terms of Use (TOU) and the Privacy Policy.

3. How do we collect information about our users?

A) We collect information through your entry, connection, access, and/or use of the Site and/or Platform. In other words, when you use the Site and/or Platform, we are notified and may collect, gather, and store information related to such usage (such as the Non-personal Information outlined above and your IP address), either independently or with the assistance of our authorized third-party service providers, as elaborated below.

B) We gather information that you voluntarily provide to us. For instance, we collect Personal Information when you register and open an Account, or when you contact us through our Contact Form.

C) We gather Personal Information from your E-commerce Account(s) that you've linked to your Account. Information and data that could be considered Personal Information are collected from the E-commerce Account(s) you've connected to your Account, which are managed by third-party e-commerce service providers (e.g., Amazon.com), utilizing the APIs of these third parties (via the open standard for authorization, OAUTH).

4. Sharing Information with Third Parties

We acknowledge the highly sensitive nature of the information you upload to the Platform. TOPS Repricer is committed to not sharing any Personal Information it collects with any third party, except under extreme circumstances outlined as follows: (a) to comply with applicable law, regulation, legal process, subpoena, or governmental request; (b) to enforce this Privacy Policy and/or the Terms of Use, including the investigation of potential violations thereof; (c) to detect, prevent, or address fraud, security, or technical issues; (d) to respond to claims that contact information (e.g., name, email address, etc.) of a third party has been posted or transmitted without their consent or as a form of harassment; (e) to protect the rights, property, or personal safety of the Company, its Users, or the general public; (f) in the event of any change in control, such as merger, acquisition, or purchase of all or substantially all of the assets of the Company, provided that the acquirer maintains the same privacy terms; or (g) with your explicit approval prior to disclosure, for example, when you request our assistance in completing forms or other materials to be submitted to applicable entities (e.g., governmental or public authorities) based on the User Data. In such cases, we will share your relevant personal information with the applicable entity to provide you with the requested service. It should be noted that we collect, hold, and/or manage your Personal Information through TOPS Repricer’s authorized third-party vendors of certain products or services (such as hosting cloud services), including their affiliates, solely for the purpose of providing us with the requested services and not for any other purposes. These vendors may be located in a country that does not have the same data protection laws as your jurisdiction.

To clarify, TOPS Repricer reserves the right to transfer and disclose Non-personal Information to third parties at its discretion, including but not limited to statistical, analytical, and research purposes, as well as for customization, development, and improvement of our Platform.

5. Direct Marketing

You hereby agree that we may use the contact details you provided us with (including, without limitation, email address and phone number) for the purpose of providing you with commercial and/or non-commercial materials related to our current and/or future products and services. You may withdraw your consent by sending a written notice to TOPS Repricer’s email address as displayed on the Site and/or Platform. Alternatively, you can follow the instructions for removing yourself from the mailing list, which are available in the messages transmitted to you.

6. Links to Third-Party Websites

Certain links provided on the Site and/or Platform allow Users to exit our Site and/or Platform and access non-TOPS Repricer sites or services. These linked sites and services are offered solely for your convenience. They are not under the control of TOPS Repricer, and we are not responsible for the availability of such external sites or services. TOPS Repricer does not endorse these linked sites and services and is not responsible or liable for any content, advertising, products, services, or other information on or available from such linked sites and services, or for any link contained in a linked site or service. TOPS Repricer reserves the right to terminate any link at any time.

You acknowledge and agree that TOPS Repricer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such linked sites or resources.

Most of these linked sites and services provide legal documents, including terms of use and privacy policies governing their use. It is advisable to read these documents carefully before using those sites and services to understand the type of information they are collecting.

7. Cookies & Local Storage

When you access or use the Site and/or Platform, we and/or our third-party service providers may utilize industry-wide technologies such as User persistent identifiers (or similar technologies), which store certain local information on your device ("Local Storage"). This Local Storage may enable, among other things, the automatic activation of certain features and enhance the User’s Site and/or Platform experience by making it simpler, more relevant, convenient, and effortless. Such information is stored locally on the User’s device, and TOPS Repricer and/or our authorized third-party service providers may access it.

We may use both session cookies (which expire once you close the Site and/or Platform) and persistent cookies (which remain on the User’s device until deleted). The Local Storage utilized by the Platform may store non-personal information (such as the different pages viewed by a User within the Site and/or Platform) as well as User persistent identifiers, collected in accordance with the specified terms herein.

8. Security

We employ measures to uphold the security and integrity of our Site and/or Platform and User Data, aiming to prevent unauthorized access or use through widely accepted industry-leading security standards, technologies, and internal procedures. Personal Information and User Data are hosted on Amazon Web Services Cloud servers, known for their advanced and strict security standards (both physical and logical). Additionally, we utilize highly secure service design and implementation, incorporating state-of-the-art encryption and architectural mechanisms.

Moreover, we implement secure permission management and auditing systems through specific and proprietary firewall and network access filtering, as well as security group mechanisms.

However, it's important to acknowledge that there are inherent risks in transmitting information over the Internet or through other electronic storage methods, and we cannot guarantee that unauthorized access or use will never occur. TOPS Repricer shall not be responsible or liable for unauthorized access, hacking, or other security intrusions or failure to store or theft, deletion, corruption, destruction, damage, or loss of any data or information included in the user data.
